TERMS OF USE OF THE INTERNET SERVICE

The purpose of these terms of use is to help respect and protect the internet service provided by the Service Provider, its users and internet users in general against any illegal and/or harmful activity. In these terms of use, the terms “we”, “us” and “ours” mean the Service Provider as defined in the provision of services and provision of office(s) contract; the terms “you” and “yours” mean the User as defined in the provision of services and provision of office(s) contract.

The Service Provider provides a level of service and guarantee of access to the User.



1. Equipment: The User may not under any circumstances install cables, specific IT equipment (other than a laptop computer (or a desktop computer), a personal printer, mobile computer peripherals or telecommunications connections, without the prior written consent of the Service Provider, which reserves the right to refuse the installation or to have it carried out by its subcontractor, at its own discretion. The same applies to any non-office equipment or household appliances. Prior to its installation, the User must ask the Service Provider to ensure its compatibility with the existing equipment, to supervise the installation of any computer system or any specific electrical system used in the Centre. As part of its obligations, the Service Provider must check that these installations do not disrupt the use of the workspaces of other customers of the Centre, its own installations or the installations of the owner of the building. These verifications or specific technical services shall be carried out at the User’s expense.

2. Content: The User accepts and acknowledges that any information, data, text, software, music, sound, photograph, graphic, video, message and other content (hereinafter referred to generically as the “Content”) is published or transmitted privately under the sole responsibility of the person who made such publication or transmission. This means that the User is solely responsible for the Content downloaded, posted, sent by email or transmitted by any other means whatsoever via the internet service. Under no circumstances can we be held liable for the Content, errors or omissions that they may contain, or for any loss or damage of any kind whatsoever resulting from the use of the internet service, regardless of the Content available to be downloaded, posted, sent by email or made available by any means whatsoever via the internet service.

3. Behaviour: When using the internet service you must not: a. Make available for download, download, post, email or any other means any item or Content: (i) that is unlawful, harmful, sadistic, cruel, threatening, abusive, constituting harassment, defamatory, vulgar, obscene, infringing the privacy of others, hateful, sectarian, racist or otherwise unacceptable; (ii) that infringes a patent, trademark, trade secret, copyright, database rights or any other intellectual property right belonging to a third party; (iii) that constitutes unsolicited or unauthorised advertising, such as “junk mails”, “spam”, “chain letters”, “paid chain letters” or any other form of solicitation; (iv) that causes or attempts to cause harm to minors in any way whatsoever; (v) that contains viruses, worms, Trojan horses or any other computer code, file or program created to interrupt, prevent, damage, destroy or limit the operation of any computer or telecommunications software or hardware; (vi) that directly or indirectly interferes with or disrupts the internet service or servers or the network connected or accessible from the internet service or that violates the requirements, procedures or rules applicable to networks connected or accessible from the Service; (vii) is likely to pursue or harass anyone; or (viii) that constitutes a collection or attempted collection or recording of personal data concerning other users without their prior notice and/or consent. b. Impersonate another person or entity, the moderator of a forum, a guide or guest, or any other capacity that you do not have or that would inaccurately represent your relationship with a person or entity. Obtain unauthorised access to any information, networks or communication systems. c. Counterfeit headers or manipulate identifiers in any way whatsoever in order to conceal or distort the origin of the Content transmitted via the internet service.

4. Compliance with laws and Terms of Use and instructions: We may at any time reasonably and fairly investigate any suspected or alleged breach of these terms and conditions of use. We reserve the right to take any action we deem appropriate and proportionate in the event of a breach of these terms and conditions of use. b. You will comply with any reasonable instructions that we may give you from time to time in connection with your use of the internet service.

5. Exclusion of liability clauses: You expressly acknowledge and agree that: a. Any item downloaded or otherwise obtained via the internet service is carried out under your sole responsibility and at your sole risk; in particular, you are solely responsible for any damage or other loss of data or modification of data caused to your computer equipment or any other equipment caused by such downloads. While reasonable measures are in place to protect the security and integrity of internet access, we cannot guarantee the security of the use of a connection. Accordingly, you agree to use such services under your sole responsibility and risk, and acknowledge that you are solely responsible for any damage or loss of data caused to your computer hardware or any other equipment as a result of such use. You are informed that there is no guarantee of unavailability or disruption, in whole or in part, of the service linked to our service provider, as well as of the performance relating to the volume and transmission of data. Users must take the necessary measures to ensure the security of their network (or their internet entry points) and the security and backup of the information they deposit there.

6. Indemnification: You will only use the internet service within a strict legal framework; you guarantee us against any claim, cost, loss, expense (including any legal costs) or legal proceedings or any liability arising from the use of the internet service and your use of the Content available to be downloaded, downloaded, posted or transmitted in any way by means of the internet service in accordance with these terms of use (this includes, in particular, any claim based on privacy, defamation, breach of copyright or any other intellectual property right) if such claims, demands or proceedings are brought against us or alleged by a third party against whom you are at fault and in connection with your use of the service and the Content.

7. General provisions: These Terms and Conditions of Use are subject to French law and the parties grant non-exclusive jurisdiction to the French courts.
